Pandabase respects intellectual property rights and expects all users to do the same. This policy covers copyright, trademarks, and the process for reporting infringement.
1. Copyright and DMCA
Pandabase complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the platform infringes your copyright, you may submit a takedown notice.
1.1 Filing a DMCA Takedown Notice
Send a written notice to legal@pandabase.io including:
- Your name, address, and contact information.
- Identification of the copyrighted work you claim is infringed.
- Identification of the infringing material and its location on the platform (URL or description).
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature.
1.2 Counter-Notice
If your content was removed and you believe the takedown was in error, you may submit a counter-notice to legal@pandabase.io including:
- Your name, address, and contact information.
- Identification of the removed material and its previous location.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- Consent to the jurisdiction of the federal court in your district (or Florida if outside the US).
- Your physical or electronic signature.
Pandabase will restore the material within 10–14 business days unless the complainant files a court action.
1.3 Repeat Infringers
Pandabase will terminate accounts of users who are repeat copyright infringers.
2. Trademarks
2.1 Pandabase Trademarks
“Pandabase”, the Pandabase logo, and related marks are trademarks of Pandabase. You may not use them without prior written permission, except to accurately refer to Pandabase in a descriptive, non-misleading manner.
2.2 Merchant Trademarks
Merchants retain ownership of their trademarks. By using the platform, Merchants grant Pandabase a limited license to display their trademarks solely for the purpose of providing the services.
2.3 Trademark Complaints
If you believe a Merchant is infringing your trademark, contact legal@pandabase.io with:
- Your trademark registration details (or evidence of common law rights).
- The infringing content and its location on the platform.
- An explanation of how the use constitutes infringement.
Pandabase will investigate and take appropriate action, which may include removing the content or suspending the account.
3. Merchant Responsibilities
Merchants represent and warrant that:
- They own or have valid licenses for all content they upload or sell.
- Their Products do not infringe any third-party intellectual property rights.
- They will promptly respond to any IP complaints forwarded by Pandabase.
Merchants who repeatedly infringe intellectual property rights will have their accounts terminated.
4. Pandabase Content
All content created by Pandabase — including the website, documentation, design, and software — is the property of Pandabase and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.
